CONSTITUTION OF COMMISSIONERS

The constitution of EAIC Commissioner is in accordance with the provision of the subsection 5(1) of Act 700, which states that the Yang di-Pertuan Agong shall, on the advice of the Prime Minister, appoint not more than seven Commissioners, of whom there shall be a Chairman and a Deputy Chairman, for such period and on such terms and conditions as may be specified in the instrument of appointment. This appointment is for a term not exceeding 3 years and each Commissioner cannot hold office for more than two consecutive terms in accordance with subsections 7(1) and (2) of Act 700.

The appointment of the Fourth-Term Commissioners, effective from 1 July 2020 until the present consists of:

  2. YBhg. Tan Sri Datuk Zainun Ali (Deputy Chairman);
  3. YBhg. Tan Sri Mahmood Adam (Commissioner);
  4. YBhg. Tan Sri Dato' Wira Aziah Ali (Commissioner)
  5. YBhg. Dato' Alizatul Khair Osman Khairuddin (Commissioner);
  6. YBhg. Dato' John Louis O'hara (Commissioner); and
  7. YBrs. Prof. Dr. Nik Ahmad Kamal Nik Mahmod (Commissioner).

YBHG. TAN SRI SIDEK HASSAN's appointment as the Chairman of EAIC was granted by Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI, effective from 1 July 2020 for a period of 3 years.

YBhg. Tan Sri Sidek Hassan graduated with a Bachelor of Economics (Honours) (Public Administration) from the University of Malaya in 1974 and a Master of Business Administration (MBA) from Southern New Hampshire University in 1984. He also attended the Advanced Management Program at Harvard Business School in 2001.

YBhg. Tan Sri Sidek Hassan served in the Civil Service as an Administrative and Diplomatic Officer for 38 years, with the last 6 years of his service as the Chief Secretary to the Government (KSN) until he turned 61 on 24 June 2012. As the KSN, he was the Chairman of the Malaysian Integrity Institute (IIM), an institution that was actively involved in the establishment of the Malaysian Anti-Corruption Commission (MACC) to replace the Anti-Corruption Agency (BPR) in 2009, as well as the Whistleblower Protection Act 2010 [Act 711].

He started his career in the Civil Service on 15 April 1974 as the Assistant Director at the International Trade Division, Ministry of Trade and Industry (MITI), and worked at MITI Offices in Tokyo (Japan), Sydney (Australia) and Washington DC (United States), contributing to his extensive experience at MITI. He was appointed the Deputy Secretary-General (Trade) at MITI on 19 January 2001 and the Secretary-General on 24 October 2004.

He also led several higher education institutions, including as the President of International Islamic University Malaysia (IIUM) from 2008 to 2013 and as the Pro-Chancellor of Universiti Teknologi PETRONAS (UTP) from 2012 to 2018.

YBhg. Tan Sri Sidek Hassan was the Chairman of Petroliam Nasional Berhad (PETRONAS) from July 2012 to June 2018.

In addition, he served as the Chairman of KLCC Property Holdings Berhad, KLCC REIT Management Sdn. Bhd. and KLCC Holdings Sdn. Bhd. YBhg. Tan Sri Sidek Hassan was also appointed the Chairman of the Malaysia Digital Economy Corporation (MDEC) from 2016 to 2018. He was also a member of the Board of Directors of Top Glove Corporation Berhad and Malayan Flour Mill Berhad.

YBHG. TAN SRI DATUK ZAINUN ALI graduated with a Bachelor of Laws (LL.B) (Honours) from the University of Malaya and a Master of Laws (LL.M) from the University of Cambridge, United Kingdom (1984).

YBhg. Tan Sri Datuk Zainun Ali held various positions in the legal and judicial fields throughout her career since 1976. She started serving as a Company Registrar at the Ministry of Domestic Trade and Consumer Affairs in October 1990. In November 1994, she undertook the role of the Chief Registrar at the Federal Court of Malaysia and was later appointed as a Judicial Commissioner at the Kuala Lumpur High Court in August 1996. In 2012, Ybhg. Tan Sri Datuk Zainun Ali was appointed as a Federal Court Judge. Ybhg. Tan Sri Datuk Zainun Ali is a member of the International Association of Women Judges based in Washington DC, United States.

Ybhg. Tan Sri Datuk Zainun Ali is among the 10 Judge Members of the Advisory Board of the United Nations Global Judicial Integrity Network, which strives to improve judicial integrity around the world.

Ybhg. Tan Sri Datuk Zainun Ali was appointed the Chairman of the Board of Directors of Malaysia Airports Holdings Berhad (MAHB) in 2019. She was also a member of the Board of Directors of Permodalan Nasional Berhad (PNB) in the same year.

Ybhg. Tan Sri Datuk Zainun Ali was appointed a member of the Administrative Tribunal at the Islamic Development Bank, Jeddah in 2021. She is also an arbitrator at the Asian International Arbitration Centre (AIAC).

Effective 1 July 2020, Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI has granted her appointment as the EAIC Deputy Chairman for a period of 3 years.

YBHG. TAN SRI MAHMOOD ADAM graduated with a Bachelor of Arts (B.A.)(Honours) from the University of Malaya in 1976.

YBhg. Tan Sri Mahmood Adam began his service as a General Administrative Officer at the Immigration Department of Malaysia in 1976 and subsequently as an Administrative and Diplomatic Officer at several other federal Civil Service agencies, namely the Ministry of Defence (1981), the Public Service Department (1986), the Prime Minister’s Department (1992) and the Ministry of Foreign Affairs (1996). YBhg. Tan Sri Mahmood Adam has experience serving as the Chief Government Security Officer of Malaysia in the Office of the Chief Government Security Officer of Malaysia, Prime Minister’s Department in 2003, and was subsequently appointed as the Secretary of the House of Representatives in the Malaysian Parliament in 2006.

YBhg. Tan Sri Mahmood Adam also held a number of executive positions in the Civil Service, namely the Deputy Secretary-General (Administration) at the Ministry of Defence (2007), the Director-General of the Immigration Department of Malaysia (2008), the Secretary-General of the Ministry of Home Affairs (2009) and the Chairman of the Public Service Commission as well as the Chairman of the Judicial and Legal Services Commission (2012-2015).

His appointment as an EAIC Commissioner has been granted by Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI, effective from 1 November 2020 for a period of 3 years.

YBHG. TAN SRI DATO' WIRA AZIAH ALI graduated with a Bachelor of Laws (Honours) from the University of Malaya in 1976.

YBhg. Tan Sri Dato' Wira Aziah Ali began her legal and judicial profession in 1976 at the Ministry of Defence, and then at the Attorney-General's Department (1978) and the Public Service Department (1988). Subsequently, she was appointed a Senior Judge of the Sessions Court, Negeri Sembilan (1992), a Registrar of the High Court of Malaya (1994) and served as a Negeri Sembilan's Legal Advisor in 2001 before being appointed the Director-General of the Judicial and Legal Training Institute (ILKAP) in the same year.

YBhg. Tan Sri Dato' Wira Aziah Ali was then appointed a Judge of the Kuala Lumpur High Court in 2007, Judge of the Court of Appeal in 2011 and Judge of the Federal Court in 2016.

YBhg. Tan Sri Dato' Wira Aziah Ali was appointed a member of the Appeal Committee of the Securities Industry Dispute Resolution Center (SIDREC) at the Securities Commission Malaysia on 1 September 2020.

Her appointment as an EAIC Commissioner has been granted by Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI, effective from 1 November 2020 for a period of 3 years.

YBHG. DATO' ALIZATUL KHAIR OSMAN KHAIRUDDIN graduated with a Bachelor of Laws (Honours) from the University of Malaya in 1976 and a Master of Laws from the London School of Economics, University of London, United Kingdom, in 1982.

YBhg. Dato' Alizatul Khair Osman Khairuddin has extensive experience in the legal and judicial fields since 1976. She began her career as a Legal Advisor at the Ministry of Education in 1984, and then as the Deputy Head of the Legal Division at the Attorney General's Department and Penang Legal Advisor at Penang Legal Advisor's Office in 1995.

YBhg. Dato' Alizatul Khair Osman Khairuddin was later appointed a Judicial Commissioner at the Shah Alam High Court (2003), Judge at the Shah Alam High Court (2004), Judge at the Kuala Lumpur High Court (2008), Judge at the Court of Appeal (2011) and Judge at the Federal Court (2017-2019).

Her appointment as an EAIC Commissioner has been approved by Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI, effective from 1 November 2020 for a period of 3 years.

YBHG. DATO' JOHN LOUIS O'HARA graduated with a Bachelor of Laws (Honours) from King's College, University of London, in 1974 and served as a Barrister-at-Law at Lincoln's Inn, London, in 1976.

YBhg. Dato John Louis O'Hara has extensive experience in the legal and judicial fields. He began his career as a Magistrate at the Kuala Lumpur Magistrates' Court (1976-1977), and then as a Deputy Public Prosecutor (1977-1982), Senior Federal Attorney at the Advisory and International Division of the Attorney-General's Department (1982-1988) and Legal Advisor at the Ministry of Defence (1988-1992).

After that, he was appointed a Senior Judge in the Kota Bharu Sessions Court (1992-1994), Legal Advisor at the Ministry of Foreign Affairs (1994-1999), Deputy Head of the Legal Division of the Attorney-General's Department (1999) and Chairman of the Industrial Court (2000- 2001). He was also appointed the Chairman of the Advisory Board of the Prime Minister's Department (2002-2003) and the Head of the International Affairs Division at the Attorney General's Department (2003-2005).

YBhg. Dato' John Louis O'Hara was then appointed a Judicial Commissioner at the Penang High Court (2005-2007), Judge at the Penang High Court (2007-2010) and Judge at the Kuala Lumpur High Court in 2011 until his retirement in 2017.

Effective 1 July 2020, Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI has granted the appointment of YBhg. Dato' John Louis O'Hara as an EAIC Commissioner for a period of 3 years.

YBRS. PROF. DR NIK AHMAD KAMAL NIK MAHMOD graduated with a Bachelor of Laws from the University of Malaya in 1986, a Master of Laws from King's College, University of London, England, in 1988, a Diploma of Shariah Training and Practice from International Islamic University Malaysia (IIUM) in 1991 and a Doctor of Philosophy Degree from the University of Aberdeen, Scotland, in 1995.

He started his career at IIUM in 1986, serving as a tutor before being appointed as a lecturer in 1988. In addition to serving as a lecturer, he also held administrative positions in academic management and student affairs. He had held the positions of Deputy Dean of Faculty, Dean of Faculty and Deputy Rector (Student Affairs). He was subsequently appointed a Legal Advisor at IIUM from 2012 to 2016.

Also, he was a member of several important committees at IIUM, namely the Chairman of the Technical Committee for Management Regulation and Control, Chairman of the Trust Account Committee for the Trust Account of Employees in Default (T-118-0001), Member of the Disciplinary Committee (Staff and Students), Chairman of the Student Affairs Committee, Chairman of the Technical Committee for Good Governance, Core Team Member for Strategic Planning and Member of the Academic Integrity Committee.

At the national level, he was a member of the Malaysian Law Deans Council and the National Council of Deans of Postgraduate and the Chairman of the Malaysian Qualification Framework Standards for Law and Shariah Curriculum Programmes. He is the External Examiner for the Law and Shariah Programme at Universiti Sultan Zainal Abidin (UniSZA) and Universiti Sains Islam Malaysia (USIM). He is also a Certified Integrity Officer (CeIO).

On 1 July 2020, Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XVI granted the appointment of YBrs. Prof. Dr Nik Ahmad Kamal Nik Mahmod as an EAIC Commissioner for a period of 3 years.
